Project Development

Overview

We represent developers in structuring, negotiating, and financing complex development projects. We manage our clients’ needs among the other stakeholders in a project, including lenders, tenants and public authorities in order to achieve practical and cost-effective solutions for our clients. We identity issues during each phase of a development project, from site evaluation, due diligence, acquisition, permitting, zoning, and financing, to construction, leasing, and disposition. We handle substantial commercial real estate projects, including retail, office, multifamily, industrial and mixed-use developments.

We represent developers in the conversion of property to residential, commercial, mixed-use and phased condominiums. We carefully craft working documents, including condominium documents, easement agreements, cost-sharing agreements, and other types of documents that allocate rights and obligations among various users to avoid potential disputes and facilitate project success.

Experience

  • Represented the developer in the development of the Muse, a brick and beam loft building with 38 residential condominium units on Melcher Street in the Seaport District. This project included preparing all project sale documents, advising on condominium management and budget issues, and handling all unit sales.
  • Represented the developer in the acquisition, development and financing of a three-phased mixed-use development consisting of a synagogue, mikvah and a 75-unit apartment building, including an underground parking garage in the Brighton neighborhood of Boston. This project required a land swap agreement and reciprocal easement agreement for shared utilities and common areas.
  • Represented the developer in the revival and acquisition of phase two development rights to build 12 condominium units in the Dorchester neighborhood of Boston. This project required negotiating with an interested abutter throughout the permitting process.
  • Represented the developer in the acquisition, development, and financing of an historic church and rectory building in a two-project phased condominium development in the Beacon Hill neighborhood of Boston, consisting of luxury residential units and commercial office space.
  • Represented the developer in the development of a 112-unit phased townhouse condominium project consisting of 16 phases in Norwood, Massachusetts. This project included the preparation of condominium documents, phasing amendments and sale documents, as well as the managing of unit sales.
  • Represented the developer in the development of an 80-unit mixed-use condominium project consisting of market rate residential units, affordable residential units and commercial retail units in the historic Filene’s Building in Worcester, Massachusetts. This project included the preparation of condominium documents and sale documents, and the managing of unit sales.
  • Represented the developer in the development of a 22-unit LEED certified townhouse condominium project in the South Boston neighborhood of Boston. This project included the preparation of condominium documents, phasing amendments, and sale documents, and managing unit sales.
